Expert Testimony & Written Opinions for Data Breach Matters

Expert Testimony & Written Opinions

IP Expert Witness provides the core deliverables of formal expert witness practice in data breach litigation: sworn opinions and testimony that meet evidentiary standards and withstand cross-examination.

Services

Expert Reports & Declarations — Written opinions prepared under Rule 26(a)(2)(B) and other evidentiary standards, documenting technical findings for the court.

Deposition Testimony — Sworn testimony given during pre-trial depositions, where the expert is questioned by opposing counsel.

Trial Testimony — Testimony before judges, juries, or arbitrators, translating complex technical concepts into plain language for the trier of fact.

Rebuttal Reports & Testimony — Critical analysis challenging the methodology, findings, and conclusions of an opposing party’s expert.

Affidavits & Declarations in Support of Motions — Sworn written statements submitted as evidence in pre-trial motion practice, such as motions to dismiss or for class certification.

Special Master / Neutral Expert Services — Serving as a court-appointed independent expert or Special Master to provide neutral technical evaluations.

Why This Matters

A technically sound investigation only helps a case if it can be communicated credibly under oath. Written opinions have to meet evidentiary standards, and testimony has to hold up against aggressive cross-examination on both the underlying technical findings and the methodology used to reach them.

How Engagement Typically Works

Engagement typically begins with a technical review of the case materials, followed by investigation and analysis, a written expert report, and then deposition and, where the case proceeds, trial testimony. Rebuttal work follows the same structure in response to an opposing expert’s report.

When to Engage

Engaging early allows expert testimony to be built on a complete technical record rather than reconstructed after key discovery deadlines have passed.
